1. About Beatrice Livesey
This website is operated by Beatrice Livesey, an independent artist offering original paintings, artwork and commission services.
Throughout these Terms & Conditions, references to “Beatrice”, “I”, “me” or “my” refer to Beatrice Livesey.
2. Using this website
You may use this website for lawful purposes only.
You must not use the website in a way that could damage, disable, overburden or interfere with the website or its operation.
Information on the website is provided for general information and may occasionally contain errors or require updating.
3. Original artwork
All paintings offered for sale through this website are original works of art unless otherwise stated.
Artwork descriptions, dimensions, materials and other details are provided on the relevant product page.
Every original painting is an individual piece. Once an original artwork has been sold, it may no longer be available for purchase.
Every effort is made to ensure that photographs represent the artwork accurately. However, colours may appear slightly different depending on your device, screen settings and lighting conditions.
4. Artwork availability
As the artwork sold through this website consists primarily of individual original pieces, availability may change at any time.
If an artwork is shown as available but is no longer available when you place an order, Beatrice will contact you as soon as reasonably possible and arrange an appropriate resolution, including a refund where applicable.
5. Prices
Prices for artwork are displayed on the website alongside the relevant product.
Prices may be changed from time to time. Any change in price will not affect an order that has already been accepted.
Any applicable taxes or charges will be shown as part of the purchasing process where required.
6. Orders and payment
When you place an order through the website, you are making an offer to purchase the artwork shown in your order.
An order is subject to acceptance and availability.
Payment must be successfully received before artwork is released for delivery or collection.
Payments made through the website are processed using the payment services available through the website. Beatrice does not have access to or store your full payment card details.
If there is a problem with your payment or order, Beatrice may contact you using the contact information provided at checkout.

7. Ownership of artwork
When you purchase an original painting and payment has been received in full, ownership of the physical artwork will transfer to you, subject to any applicable delivery or collection arrangements.
Purchasing a physical painting does not transfer copyright or intellectual property rights in the artwork to the purchaser.
8. Copyright and intellectual property
All copyright and intellectual property rights relating to Beatrice's artwork remain with Beatrice Livesey, unless otherwise agreed in writing.
This includes artwork that has been sold to a customer.
Purchasing an original painting does not give the purchaser the right to:

Claim the artwork as their own work
Any reproduction or commercial use of Beatrice's artwork requires her prior written permission unless permitted by law.
9. Website content
The content of this website, including photographs, artwork images, text, logos, graphics and other material, belongs to Beatrice or is used with permission.
You must not reproduce, copy, distribute, modify or commercially use website content without prior permission, unless permitted by law.
10. Commissions
Beatrice may accept commissions for original paintings.
Commission requirements, subject matter, reference photographs, size, materials, price and estimated completion time will be discussed and agreed before work begins.
A commission will only be started once the relevant arrangements have been agreed.
Because commissioned artwork is created specifically for an individual customer, commissioned work may be subject to different cancellation and return arrangements from standard artwork available for purchase.
Further information about commissions and any applicable arrangements will be provided before a commission is accepted.
Copyright in commissioned artwork remains with Beatrice unless a separate written agreement states otherwise.
11. Photographs and reference material for commissions
Where a commission is based on photographs or other material supplied by a customer, the customer is responsible for ensuring that they have the necessary permission to provide and use that material.
The customer should only provide photographs or other material that they are entitled to use for the purpose of creating the commission.
12. Personal use of purchased artwork
A purchaser may display an original artwork they have purchased for their personal enjoyment.
Purchasing the physical artwork does not give the purchaser copyright ownership or permission to reproduce the artwork.
13. Website availability and errors
Every reasonable effort is made to keep the website accurate and available.
However, Beatrice does not guarantee that the website will always be available, uninterrupted or free from errors.
Information, artwork availability, prices or other website content may occasionally contain errors. Beatrice reserves the right to correct errors and update information where necessary.
14. Third-party services
The website is operated using third-party services, including Wix and payment providers.
These services may process information or provide functionality necessary for the website and online shop to operate.

15. Liability
